Distance Sales Contract & Pre-Information

1. Parties — Seller

Seller: ArcadeServers (HecekaSoft). Email: [email protected]. Website: https://arcadeservers.com. NOTE: the seller's legal name, full address and tax/ID number are being finalised for inclusion; once complete the contract will be updated and its new version presented for your acceptance. In the meantime you may send any request or notice to the email address above.

2. Parties — Buyer

The Buyer is the person who creates an ArcadeServers account and tops up their wallet. The name and email registered on the account, together with the details given at payment, are taken as the basis. If the Buyer is under 18, they declare that they act with the consent of their legal representative.

3. Subject of the contract

The subject of this contract is the Buyer's prepaid top-up of COINS to their ArcadeServers wallet. 1 coin = 1 TL in value. A coin is a unit of account used solely within ArcadeServers services (hourly server usage, file protection add-on, custom domain right, etc.); it is not money, cannot be transferred to third parties and — except in the cases stated here and in the Refund Policy — cannot be converted to cash.

4. Price and payment

• The number of coins and the total amount payable, including taxes and processing fees, are shown clearly at the payment step before you confirm.
• Payment is taken by credit/debit card through the secure page of the payment institution (Shopier). Your card details are never seen or stored by the Seller.
• As soon as payment is approved the chosen coin amount is credited to your wallet in full; taxes and service fees included in the amount paid are not deducted from the coins.
• There is no delivery or shipping fee; the service is provided electronically.

5. Performance and delivery

The coin top-up is performed electronically immediately after payment approval (typically within seconds). If payment is approved but your balance is not credited within 20 minutes, the system recovers the top-up automatically; if the issue persists, simply email [email protected].

6. Right of withdrawal

The Buyer has the right to withdraw from this contract within 14 days without giving a reason. Send your withdrawal notice to [email protected] or via Support in the panel; the refund is made to the original payment method within 14 days at the latest.

7. Exception to the right of withdrawal (IMPORTANT)

Under article 15/1-(h) of the Turkish Distance Contracts Regulation, the right of withdrawal cannot be used for services performed IMMEDIATELY with the Buyer's consent. Accordingly: once you start a server using your coins, the service is deemed performed for the coins consumed and the right of withdrawal ends for that part. The right applies in full to UNSPENT coins. By approving this contract at the payment step, the Buyer declares that they consent to immediate performance and understand that the right of withdrawal is lost for the consumed part.

8. Validity period and balance

There is no expiry on topped-up coins; they can be used as long as your account remains open. When your balance can no longer cover the hourly fee, the server is safely put to sleep and your world is archived (see Terms of Service, art. 5).

9. Defective service and liability

If the service is not provided as required, the Buyer may exercise their statutory rights under Law No. 6502. The Seller's liability applies within the framework of the 'Limitation of liability' clause of the Terms of Service; that limit does not remove statutory consumer rights.

10. Complaints and disputes

Send requests and complaints to [email protected] or via the Support section of the panel; we respond within 3 business days. In case of a dispute, applications may be made to the Consumer Arbitration Committees at the Buyer's place of residence within the monetary limits announced annually by the Ministry of Trade, and to the Consumer Courts above those limits.

11. Storage of the contract

This contract is recorded electronically at the moment you accept it (together with the accepted version, date and IP address) and is sent to you on request. Records are retained for the purposes of the burden of proof.

12. Entry into force

The Buyer accepts that they have read and approved this contract and the pre-information at the payment step and then made the payment. The contract enters into force upon approval of the payment.
